Syneos Health Partner Insights Program - Terms and Conditions

Syneos Health™ has created the Partner Insights Program (the “Program”) to provide incentives to Health Care Practitioners (“HCP or HCP’s”) for their time in completing surveys distributed by Syneos Health™ through Program points that are redeemable for a variety of e-gift cards from major retailers and restaurants.  Any HCP’s participation (or continued participation) in the Program is entirely voluntary, is pursuant to invitation from and pursuant to the sole discretion of Syneos Health™, and is subject to these Terms and Conditions (and other Program rules, conditions, policies or procedures), which may be established, changed, cancelled or modified at any time by Syneos Health™ in its sole discretion on a prospective and retroactive basis.  Any participating HCP agrees to be bound by these Terms and Conditions, and is responsible for checking the Program website for any changes to these Terms and Conditions (which will be posted on the website).

All information submitted by HCP’s in response to Program surveys (and any resulting data, information or analysis derived from such information) shall be the sole and exclusive property of Syneos Health™ and all Program participants acknowledge and agree that Program points that are redeemable for e-gift cards pursuant to these Terms and Conditions are the only form of potential compensation which will be provided for their participation in the Program.

Eligibility

Syneos Health™ has the sole discretion to determine whether an HCP is eligible to participate (or continue participating) in the Program.  Any participating HCP who fails to comply with these Terms and Conditions or other Program rules, conditions, policies or procedures, who fails to respond to the surveys in good faith, or who otherwise engages in fraudulent, illegal, deceptive or disruptive conduct in connection with the Program will be subject to losing their eligibility to participate in the Program (as determined by Syneos Health™ in its sole discretion) and their available Program points will be forfeited.

Point Redemption Process

A predetermined number of points are assigned for completing each Syneos Health™ survey, depending upon its length, complexity and estimated time to complete. When an eligible HCP submits a completed survey to Syneos Health™, they will be eligible to receive compensation for their time in completing the survey by crediting their Program account with the number of points assigned for that particular survey. Subject to these Terms and Conditions and any other Program rules, conditions, policies or procedures established by Syneos Health™, such Program points may be redeemed for e-gift cards, as long as the "point balance" meets or exceeds the "point value" of the e-gift cards selected through the fulfillment platform.  Program points are not redeemable for cash and have no cash value. 

eCards cannot be exchanged and are non-refundable; all selections are final.

Redeeming Points

An eligible HCP can redeem points on the fulfillment portal based on their available point balance for a variety of e-gift card options. Card fulfillment and delivery are managed by a third-party service provider, Tango Card.  Should you encounter any issues with fulfillment, or for specific questions about their digital award fulfillment process and policies, please contact them directly at 1-877-558-2646

Point Balance

Starting on July 1st, 2018, all points that are earned in the Program will remain valid and available for redemption through the fulfillment platform for 24 months from the time they were first earned.  HCP’s will be able to access their point status on the fulfillment portal. If points are not redeemed within 24 months, the points will be forfeited.

Inactive Status

If an HCP has not completed a survey for a period of six (6) consecutive months after their last survey submission, their Program account becomes inactive (“Inactive Status”). Any points existing at the time of Inactive Status will remain available for redemption for a period of six (6) additional months.  Any Program points not redeemed within that six-month period will be forfeited.

Tax Policy

Syneos Health™ is required to file Form 1099 with the IRS for each HCP that redeems Program points for e-gift cards with a value equivalent to or in excess of $600 in any calendar year, and must obtain the HCP’s tax identification number – "TIN" (typically a social security number) to do so properly.  Any participating HCP which meets this threshold is required to complete Form W-9 when Syneos Health™ Research & Insights, LLC, as the service recipient, requests your TIN.  If any HCP fails to provide Form W-9, Syneos Health™ is required to commence backup withholding and at its sole discretion,  Syneos Health™ will either (1) redeem any available Program points equivalent in value to this backup withholding amount, or (2) require the HCP to provide sufficient funds equivalent to the backup withholding amount to Syneos Health™.

General Provisions

Any HCP’s participation in the Program shall be subject to and governed by the laws of the Commonwealth of Pennsylvania, and any disputes relating to the Program shall be subject to the exclusive jurisdiction of the courts of the Commonwealth of Pennsylvania.

Each HCP is wholly responsible for his/her participation in the Program, use of the Program site and/or participation in any Program survey and the HCP uses the Program site at his/her own risk.

Any participating HCP acknowledges that Syneos Health™  is not responsible for, and accepts no liability in relation to, an HCP’s use of the Program site, an HCP’s conduct in connection with the Program site, or an HCP’s participation in any Program survey (whether online or offline) in any circumstance.

Each participating HCP is solely responsible for content that he/she transmits or posts via the Program site and in connection with any Program survey. Syneos Health™ disclaims all liability with respect to any content transmitted or posted on the Program site or provided in any Program survey.

Each participating HCP agrees to indemnify Syneos Health™ for any loss, damage, cost or expense that it may suffer or incur as a result of or in connection with an HCP’s use of or conduct in connection with the Program site or any Program survey, including any breach by the HCP of these Program Terms and Conditions.

To the maximum extent permitted by law, Syneos Health™ excludes all implied representations and warranties which might apply in relation to any HCP’s participation in the Program and use of the Program site.

Under no circumstances will Syneos Health™ be liable for any indirect, punitive or consequential loss or damages, loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or in any way connected to business interruption of any type as a result of any HCP’s participation in the Program.

Each participating HCP agrees that Syneos Health™ may use and share his/her personal information in accordance with Syneos Health™ privacy policies and applicable data protection laws.

PROGRAM POINTS ARE NOT REDEEMABLE FOR CASH AND HAVE NO CASH VALUE. THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE AT ANY TIME IN THE SOLE DISCRETION OF SYNEOS HEALTH™.

Our Commitment to Privacy

Your information privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.

The Information We Collect

When you register and logon to use the any portion of our web site, you are given access to a secure area that is reserved for selected individuals whose opinions are important to the pharmaceutical industry. The information and content presented by any of the Syneos Health Research & Insights web sites is limited to this specific audience of healthcare professionals; therefore, in order to control access it is important that Syneos Health Research & Insights be able to identify you. Your username and password confirms your status as a user recruited by Syneos Health Research & Insights to take part in the defined services being offered. By collecting the personal information gathered during the registration process, Syneos Health Research & Insights can immediately identify you as a legitimate registered user of the website.

This personal information includes your:

  • Name
  • Address
  • E-mail Address
  • Telephone number
  • Information specific to your line of business.

This information can be accessed on the Web site via your Account Profile page.

How Your Information is used

Information you provide during the web site registration process is stored in a secure, confidential database and is used by Syneos Health Research & Insights to customize and optimize the process when a registered user returns to the web site or participates in an online study.

Your profile is used internally by Syneos Health Research & Insights to identify those individuals willing to participate in Syneos Health Research & Insights services and receive emailed invitations to opportunities on the Web, such as an Online Market Research study.

Third Parties

Syneos Health Research & Insights will not sell, rent, lease or otherwise willingly disclose your personally identifiable information to non-authorized entities. Unless we have your consent or are required by law, Syneos Health Research & Insights will only share the personal data you provide with other Syneos Health Research & Insights internal entities and/or business partners who are acting on our behalf for the business purposes described above. Such Syneos Health Research & Insights internal entities and/or business partners are governed by our privacy policies with respect to the use of this data and are bound by the appropriate confidentiality agreements.

Aggregated Information

The user type, timing, and path of your visit to the web site is captured as click-stream data and aggregated to provide Syneos Health Research & Insights information about the use of our Web site to improve its design. This information may include, for example, the most and least requested pages and the number of users by region, among other things.

Active participation in an Online Market Research survey provides a formal feedback mechanism to Syneos Health Research & Insights survey Sponsors. These results will be de-identified and aggregated before they are reported to third parties.

Final reports of online activity provided to Sponsors will only include de-identified information. Your data will be aggregated with that of other, similar users in these reports and used as a basis on which new content can be created to better meet users' needs.

Exceptions:

Except as described above, we will not otherwise use or disclose any of your personally identifiable information, except to the extent reasonably necessary to:

  • Correct technical problems and malfunctions and to technically process your information
  • Protect the security and integrity of our Web site
  • Protect our rights and property, as well as the rights and property of others
  • Take precautions against liability
  • Meet legal requirements as determined by law or to respond to judicial processes
  • Provide information to law enforcement agencies for an investigation on a matter related to public safety, as applicable, to the extent required under other provisions of law

Security

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

The information you provide us may be archived or stored periodically by us according to backup processes conducted in the ordinary course of business. Information stored as part of this backup process will be deleted in due course on a regular schedule.

Cookies

A cookie is an encrypted data string our server stores on your hard drive that contains your unique User ID for our Web site. Cookies may be used by Syneos Health Research & Insights to deliver web content specific to your interests based on your Web site activity. Any cookies deposited on your computer are in no way linked to any personal identification information you may have provided Syneos Health Research & Insights. In addition, a cookie cannot be used to access or otherwise compromise the data on your hard drive. You can choose to change your browser settings to disable cookies if you do not want us to establish and maintain your Syneos Health Research & Insights User website relationship. Please be aware that cookies may be required to complete certain functions on some of the Syneos Health Research & Insights Web sites.

IP Addresses

In the normal operation of our Syneos Health Research & Insights web sites, we receive the IP addresses of those computers visiting the website. Your computer IP address is a number assigned to you by your Internet service provider so you can access the Internet. Although we do receive IP addresses, we do not use them to personally identify you or disclose them to others. IP address information is strictly used for troubleshooting of web site connections and use. Access to IP information at Syneos Health Research & Insights is protected in the same manner as is access to your personal information.

How You Can Access or Correct Your Information

Once logged onto a Syneos Health Research & Insights web site, you have the option of viewing and submitting changes to your profile information recorded in the system. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting you access or enabling you to make corrections. To access your personal information, click the 'My Profile' link found in the 'Members Login' area of the applicable web site.

Your Choices

You can always choose not to provide information, even though it might be needed to take advantage of such features as paid Online Market Research. If you do not wish to receive e-mail or other mail from Syneos Health Research & Insights, please adjust your Preferences on the Profile page.

The "help" portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. However, you may not be able to use important features of the site if you do not use cookies.

Links To Other Web sites

Our Web site may contain links to other Web sites. You should carefully review the privacy policies and practices of other Web sites, as we cannot control or be responsible for their privacy practices.

Notification of Changes

If we decide to change our Privacy Policy, we will post the policy changes on the home page of Syneos Health Research & Insights web site so that our users are aware of what information we collect, use and disclose. We will collect, use and disclose a user's personally identifiable information in accordance with the Privacy Policy that was in effect when such information was collected.
